The Merchant and its owner(s) or principal(s) (individually, an “Applicant”) each represents, acknowledges and agrees as follows: (1) All information and documents provided to Aquinas Capital Funding are true, accurate and complete. (2) Applicant will immediately notify Aquinas Capital Funding of any material change in such information of fnancial condition. (3) Applicant authorizes Aquinas Capital Funding to disclose all information and documents that Aquinas Capital Funding may obtain including credit reports and applications to other persons or entities (collectively, “Assignees”) that may be involved with or acquire commercial loans or purchases of future receivables (collectively, “Transactions”), and each Assignee is authorized to use such information and documents (and to share such information and documents with other Assignees) in connection with potential Transactions. (4) Each Assignee will rely upon the accuracy and completeness of such information and documents. (5) Aquinas Capital Funding is hereby given “written instructions” to obtain information from Applicant’s personal credit fle or other information from Experian or other consumer reporting agencies solely for pre-qualifying the Merchant for business funding. (6) Aquinas Capital Funding affliate, is hereby given “written instructions” to obtain information from Applicant’s personal credit fle or other information from Experian or other consumer reporting agency solely in connection with such application for cash advance. (7) Aquinas Capital Funding, Assignees, and each of their representatives, successors and designees (collectively, “Recipients”) are authorized to request and receive any investigative reports, credit reports, statements from creditors or fnancial institutions, verifcation of information, or any other information that a Recipient deems necessary. (8) Applicant waives and releases any claims against Recipients and any information-provides arising from any act or omission relation to the requesting, receiving or release of information. (9) Each owner or principal further represents that he or she is authorized to apply for business funding on behalf of Merchant.
